Lisle, Illinois-based Capital Management President Charles J. Dushek was indicted on nine counts of securities and commodities fraud in connection with an alleged securities scheme that spanned more than four years. He was also indicted on one count of making a prohibited transaction as an investment advisor. The indictment was filed Wednesday in the U.S. District Court for the Northern District of Illinois, Eastern Division. The vice president of administration at the company was also involved in the scheme. Dushek and the co-conspirator allegedly made trades and waited to allocate them until they knew if they were profitable. They then allocated the profitable trades to personal or family accounts and unprofitable trades to client accounts. Some of the companies included Caterpillar, BP, AstraZeneca, Johnson & Johnson, American Electric Power, PepsiCo, Avon Products and Walgreens. Dushek allegedly withdrew $1 million from his personal accounts that he gained through the scheme. It occurred from July 2008 through August 2012.
